1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "parent," or "guardian") and Kidgrow ("we," "us," or "our"). By downloading, installing, or using the Kidgrow application, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, please do not use the Kidgrow application.

2. Description of Service

Kidgrow is a pediatric nutrition and growth tracking application designed for parents and legal guardians of children. The app provides tools to:

• Track children's meals and nutritional intake
• Monitor growth measurements against CDC and WHO pediatric growth charts
• Analyze meal photos using AI to estimate nutritional content
• Generate reports suitable for sharing with healthcare providers
• Track supplement and vitamin intake

3. Medical Disclaimer

Kidgrow is a tracking and reference tool only. It is not a substitute for professional medical advice, diagnosis, or treatment. The nutritional estimates, growth percentiles, and calorie goals provided by Kidgrow are for informational purposes only.

Always consult your child's pediatrician or a qualified healthcare provider with any questions you have regarding your child's health, nutrition, or growth. Never disregard or delay professional medical advice based on information provided by Kidgrow.

4. Eligibility

You must be at least 18 years old to create an account. By using Kidgrow, you represent and warrant that:

• You are a parent or legal guardian of the child(ren) whose data you enter
• You have the legal authority to consent to the collection and processing of your child's information
• All information you provide is accurate and current

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete registration information
• Notify us immediately of any unauthorized use of your account
• Ensure that your account is used only to track children for whom you are a parent or guardian

6. Subscriptions and Billing

Kidgrow offers auto-renewable subscription plans that unlock full access to all features:

• Monthly Plan — billed monthly at the price displayed at purchase
• Annual Plan — billed once per year at the price displayed at purchase

Subscriptions are processed through Apple's App Store. Your subscription automatically renews unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time in your Apple ID settings under Subscriptions.

Free trials, where offered, convert to paid subscriptions at the end of the trial period unless cancelled beforehand. We do not issue refunds for partial subscription periods. Refund requests must be made directly through Apple.

7. Acceptable Use

You agree not to:

• Use the app for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the service or its related systems
• Reverse engineer, decompile, or disassemble any portion of the app
• Use automated tools to scrape, crawl, or extract data from the app
• Upload or transmit any malicious code or interfere with the proper operation of the service
• Submit false or misleading information about a child's health data

8. Intellectual Property

All content, features, and functionality of the Kidgrow application — including but not limited to text, graphics, logos, icons, and software — are the exclusive property of Kidgrow and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes in accordance with these Terms.

9. Privacy and Children's Data

Our collection and use of personal information, including information about children, is governed by our Privacy Policy, which is incorporated into these Terms by reference. We are committed to compliance with the Children's Online Privacy Protection Act (COPPA).

10. Limitation of Liability

To the fullest extent permitted by applicable law, Kidgrow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, arising from your use of or inability to use the service.

Our total liability to you for any claims arising from these Terms or your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Kidgrow application is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the app will be uninterrupted, error-free, or free of viruses or other harmful components. Nutritional estimates generated by AI are approximate and may not be accurate for all foods.

12. Termination

We may suspend or terminate your account at our sole discretion if you violate these Terms or engage in any conduct we deem harmful to other users or the service. You may delete your account at any time through the app settings, which will permanently delete all associated data.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via in-app notification or email. Continued use of the app after such notification constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.
